What documents are needed for registration in the apartment? The list of documents for registration in the apartment
It should be noted that the concept of "registration" has long been not used in Russian legislation. Since 1993, the institution of registration at the place of residence and residence has been operating in our country. However, in everyday life, many people still use this word. What documents are needed for registration in the apartment and what subtleties and nuances you need to know, you can read further.
If you need to register at a specific address where you will live permanently, then you need to prepare such papers:
- within seven days from the date of change of residence, an application for registration is submitted;
- a document that can confirm the fact that a citizen has housing (for example, a contract of sale of a house or apartment, an act of providing state, office or municipal housing, paper from apartment owners);
- a document certifying consent to the registration of other employers or owners (if any).
All documents for registration in the apartment, filed by you, must be considered within 3 days from the date of initial appeal. However, if some papers are missed, the process will naturally stretch for a longer time. After reviewing the application and making a decision, a passport is withdrawn from the citizen (for 1-2 days) to affix a registration stamp.
Temporary registration procedure
If you need to register at the place of stay, then, in principle, the documents for temporary residence will be the same as when registering at the place of residence. After arriving in another region, you must submit papers for registration no later than 90 days. In this case, your documents should be considered for 3 days.
It is important to bear in mind that if you have a permanent residence permit, then you are not withdrawn from it. In addition, a temporary registration stamp is not stamped in the passport. However, if you moved to another location within the same subject of the Russian Federation, then the person does not need to register at the place of stay and, accordingly, submit documents for temporary registration.
Registration for the child
According to the legislation of Russia, children must be registered at the same address as their parents or one of them. Moreover, the consent of other persons living with the mother or father of the child is not necessary. In particular, you will need the following documents for registration of the child:
- certificate of birth;
- application for registration of the baby;
- parents' passport (or one of them);
- marriage certificate (if available);
- documents confirming the registration of the father and mother (or one of them) at a specific address (this may be an extract from personal accounts, house register, etc.).
If the parents are registered at different addresses, when registering a child with one of the parents, you must submit a certificate from the other's place of residence that the child was not registered there. In addition, when filling out documents for the child’s registration, you will also need to provide paper confirming the consent of the second parent.
If the baby has no parents, then it is prescribed by the place of residence of the guardian, guardian, or other relatives (grandmother, aunt, etc.). But in this case, the notarized consent of such persons to register the child in their apartment (house) will be required.
Documents for registration of a newborn
Many people think that a newborn will get a residence permit automatically, but it will still be necessary to deal with formalities. In addition, even despite the fact that the law does not specify a precise term for registering a baby, it is desirable to do this within a month. Otherwise, parents can be fined up to 2500 rubles. This procedure is simple, but there are some pitfalls.
If the parents of the baby are married and live in the joint space, then they will need to submit such documents for registration of the newborn:
If the mom and dad of the newborn are registered at different addresses, then in this case an additional certificate is submitted from the place of residence of the father (mother) that the child does not have registration in their living space.
If the mother and father did not formalize their relationship at the registry office, then, in addition to these documents, they will require a certificate of paternity.
What needs to be considered?
Keep in mind that during the registration period you will be left without a passport for a couple of days. Therefore, it is better to postpone all other social and legal procedures until the citizen’s main document is returned. It is also important to note that the consent of other owners is not necessary for the registration of your child. It is enough that one of the parents is registered in the apartment.
If the privatized apartment (or share in it) belongs to you, then you need to submit a minimum of papers. What documents are needed for registration in the apartment after purchase? In particular, they will ask you:
- passport of a citizen of the Russian Federation;
- documents of title to housing (that is, directly a document on privatization);
- a statement (it is made on the spot).
If the property or its part is privatized to other persons, then it will additionally be necessary:
- the consent of the owner (notarized or filled out by such a person on the spot);
- internal passport of the owner of the apartment (house).
All papers are served in originals and with at least two copies.
Another important issue that should be covered is registration in the purchased housing. And it doesn't matter at all whether you are registering in a private house or apartment. It all depends on the basis on which the citizen claims for a particular living space. So, what documents are needed for registration in the apartment for the new owner?
If you become a homeowner, then problems with a residence permit, in fact, should not arise, since this is your property. In the housing office you will be required to:
- document that confirms the right of ownership.
Registration in the apartment where there are other tenants
If you need a residence permit in an apartment (house) where someone already legally lives, you will have to get consent from all adult residents that are registered there. In this case, the role does not play, whether it is privatized housing or municipal.
However, there are cases when citizens live in the same apartment (cottage, house), but each of them is the owner of only a certain part of the dwelling. In this case, the bills for utilities are divided, and each of them has exclusive rights only to its share. If a person fits into the living space to one of the co-owners, then the consent of the other owners is not necessary. However, if other persons older than 14 years are registered on the living space of the co-owner, then before submitting documents for registration, you will have to get their consent.
If for some reason you cannot register at the place of residence personally, then another person can do it for you, but for this you will need to issue a power of attorney for such a person.
Where to turn?
To register in any type of housing, you need to apply for the Housing Passport. He should check the papers completely and redirect them to the passport office. If consent from other owners is necessary, then their presence is required when submitting the papers.
We have figured out what documents are necessary for registration in the apartment, but it’s worthwhile to mention the terms. In the passport office, all documents are mainly drawn up within 5 working days. If we take into account the time of transmission of a package of documents, then this whole procedure usually takes no more than 10 days.
Upon arrival at the new place of residence must submit an application for re-registration during the week. For a temporary residence permit, the period for becoming registered is 90 days. If you do not keep within this temporary period, then you can incur administrative liability.
As already mentioned, in case you do not register in time, your actions will fall under Part 1 of Article 19.15 of the Administrative Code of the RF. According to this article, a fine of 1500 to 2500 rubles. In addition, responsibility may come not only from the citizen who missed the deadline for registration, but also from the owner of the property. According to Part 2 of Art.19.15 of the Code for such a person for late filing of documents for registration may impose a fine of 2,000 to 2,500 rubles. Therefore, it is better to resolve this issue in advance in order to avoid trouble.
Registration of residents, if the area does not allow
If the apartment (house) is in your property, then you are authorized to prescribe there, in principle, whom you wish, regardless of the total area of housing. What documents for registration are needed in this case, we have already indicated. Now it is worthwhile to emphasize that the introduction of close relatives (children, parents and one of the spouses) does not require permission from the landlord. However, it is necessary to obtain the consent of all adult family members who live in this apartment (house).
At the same time, and in this case, restrictions exist. If the norm of the area per person after the introduction will be less than the prescribed, the landlord has the right to prohibit to register there even close relatives. However, the newborn child will be registered with the parents (one of them) in any case.
